20 years to the fall of the Berlin wall: Demonstrators toppled 8 meters tall concrete wall in Ni’ilin

Three protest marches were held today in the West Bank to mark the 20th anniversary to the fall of the Berlin wall, which has been declared an international day of action against Israel’s barrier. In Ni’lin, the 300 demonstrators managed to topple a part of the eight meters tall concrete wall that cuts through the village’s land. Following the direct action, the army fired scores of live rounds at the demonstrators.

The concrete wall in Ni’lin – five to eight meters (15 to 25 feet) in height – has only recently been laid on the path of the wall cutting through Ni’lin’s lands, in addition to the already existing electronic barrier and razor-wire.

Since the Wall was built to allow more land to annexed to the nearby settlements rather than in a militarily strategic manner, demonstrators have been able to repeatedly dismantle parts of the electronic fence and razor-wire surrounding it. The section of the Wall in Ni’lin is the only place along the route of the barrier where a concrete wall has been erected in an attempt to deal with the civic, unarmed campaign waged by the village in protest of the massive land theft that will enable the expansion of the illegal settlements of Modi’in Il’it and Hashmonaim.

Since Israel began its construction in the year 2002, This is the first time demonstrators succeed in toppling a part of Israel’s barrier which is a concrete wall. One of the demonstrators, Moheeb Khawaja, said during the protest: "Twenty years ago no one had thought the monster that divided Berlin into two could be brought down, but in only two days in November, it did. Today we have proven that this can also be done here and now. It is our land beyond this wall, and we will not give up on it. We will win for a simple reason – justice is on our side."

Background

Israel began construction of the Wall on Ni’lin’s land in 2004, but stopped after an injunction order issued by the Israeli Supreme Court (ISC). Despite the previous order and a 2004 ruling from the International Court of Justice declaring the Wall illegal, construction of the Wall began again in May 2008. Following the return of Israeli bulldozers to their lands, residents of Ni’lin have launched a grassroots campaign to protest the massive land theft, including demonstrations and direct actions.

The original route of the Wall, which Israel began constructing in 2004, was ruled illegal by the ISC, as was a second, marginally less obtrusive proposed route. The most recent path, now completed, still cuts deep into Ni’lin’s land. The Wall has been built to include plans, not yet approved by the Army’s planning authority, for a cemetery and an industrial zone for the illegal settlement Modi’in Ilit.

Since the Wall was built to annex more land to the nearby settlements rather than in a militarily strategic manner, demonstrators have been able to repeatedly dismantle parts of the electronic fence and razor-wire surrounding it. Consequently, the army has erected a 15-25 feet tall concrete wall, in addition to the electronic fence. The section of the Wall in Ni’lin is the only part of the route where a concrete wall has been erected in response to civilian, unarmed protest.

As a result of the Wall construction, Ni’lin has lost 3,920 dunams, roughly 30% of its remaining lands. Originally, Ni’lin consisted of 15,898 dunams (3928 acres). Post 1948, Ni’lin was left with 14,794 dunams (3656 acres). After the occupation of the West Bank in 1967, the illegal settlements and infrastructure of Modi’in Ilit, Mattityahu and Hashmonaim were built on village lands, and Ni’lin lost another 1,973 dunams. With the completion of the Wall, Ni’lin has a remaining 8911 dunams (2201 acres), 56% of it’s original size.

Ni’lin is effectively split into 2 parts (upper and lower) by Road 446, which was built directly through the village. According to the publicized plan of the Israeli government, a tunnel will be built under road 446 to connect the upper and lower parts of Ni’lin, allowing Israel to turn Road 446 into a segregated-setter only road. Subsequently, access for Palestinian vehicles to this road and to the main entrances of upper and lower Ni’lin will be closed. Additionally, since the tunnel will be the only entryway to Ni’lin, Israel will have control over the movement of Palestinian residents.

Israel commonly uses tear-gas projectiles, rubber coated steel bullets and live ammunition against demonstrators.

Since May, 2008, five of Ni’lin’s residents were killed and one American solidarity activist was critically injured from Israeli fire during grassroots demonstrations in Ni’lin.

5 June 2009: Yousef Akil Srour (36) was shot in the chest with 0.22 caliber live ammunition and pronounced dead upon arrival at a Ramallah hospital.

13 March 2009: Tristan Anderson (37), an American citizen, was shot in the head with a high velocity tear gas projectile. He is currently at Tel Hashomer hospital near Tel Aviv with uncertain prospects for his recovery.

28 December 2008: Mohammed Khawaje (20) was shot in the head with 5.56mm caliber live ammunition. He died in a Ramallah hospital 3 days later on 31 December 2008.

28 December 2008: Arafat Rateb Khawaje (22) was shot in the back with 5.56mm caliber live ammunition and pronounced dead upon arrival at a Ramallah hospital.

30 July 2008: Yousef Amira (17) was shot in the head with two rubber coated steel bullets. He died in a Ramallah hospital 5 days later on 4 August 2008.

29 July 2008: Ahmed Mousa (10) was shot in the forehead with 5.56mm caliber live ammunition and pronounced dead upon arrival at a Ramallah hospital.

In total, 19 people have been killed during demonstrations against the Wall.

Israeli armed forces have shot 40 demonstrators with live ammunition in Ni’lin. Of them, 11 were shot with 5.56mm caliber live ammunition and 24 were shot with 0.22 caliber live ammunition.

Since May 2008, 87 arrests of Ni’lin residents have been made in relation to anti-Wall demonstrations in the village. The protesters seized by the army constitute around 7% of the village’s males aged between 12 and 55. The arrests are part of a broad Israeli intimidation campaign to suppress all demonstrations against the apartheid infrastructure in the West Bank.

Declassified FBI File Alleges an Israeli Intelligence Agent Worked at AIPAC

An August 13, 1984 secret communication from the FBI Washington Field Office (WFO) to the FBI director states, "WFO files disclose that AIPAC is a powerful pro-Israel lobbying group staffed by U.S. citizens. WFO files contain an unsubstantiated allegation that a member of the Israeli Intelligence Service was a staff member of AIPAC." NATO invaders bombardment kills 37 NATO invader and 43 puppet army terrorists, also wounded 19 invader and 23 puppet army terrorists in Badghis Friday 06-11-2009, heavy fighting continued throughout the day between the Mujahideen of the Islamic Emirate of Afghanistan and NATO Invader forces and their puppet army terrorists in Bala Marghab district of Badghis province. Friday morning 06-11-2009 at around 6 am local time, the fighting started when the Mujahideen with light and heavy weapons attacked the enemy Bala Marghab district headquarter, face to face heavy battle took place with the enemy, during the battle the enemy airplanes bombarded the area, in this bombardment the enemy drop bombs on it own army and puppet army terrorists, resulting in the killing of thirty-seven NATO invader and forty-three puppet army terrorists, also wounding nineteen invader and twenty-three puppet terrorists. In the battle, the Mujahideen destroyed a number of military vehicles and supply trucks of the enemy. The report adds: In this battle, two Mujahideen were martyred and five were wounded. After a 24 hours battle Invaders base destroyed in Herat Friday morning 06-11-2009, Mujahideen of the Islamic Emirate of Afghanistan attacked a NATO invaders base in Zerko area in Shendand district of Herat province, in this attack which was launched Thursday morning 05-11-2009, a twenty-four hours fighting battle took place at the end the enemy fled, in the fighting many terrorists were killed and wounded, also an enemy tank was destroyed and base was destroyed, two Mujahids were also wounded in the fighting. Mujahideen Inflicted heavy casualties on the enemy in Helmand Thursday morning 05-11-2009 at around 6 am local time, fight took place between the Mujahideen of the Islamic Emirate of Afghanistan and puppet army terrorists in Cha mirza and Chanjir areas in Nad ali district of Helmand province, in the fighting which continued for an hour, seven terrorists were killed or wounded.

According to another report, Thursday 05-11-2009, the Mujahideen using improvised explosive devices, first blew up a patrol of the enemy and then an enemy car in Nehr-e-siraj samiti area in Garishk district of Helmand province, as a result of the two blasts many enemy terrorists were killed and wounded also the vehicle was destroyed.

Israeli Occupation Forces (IOF) Continue Systematic Attacks against Palestinian Civilians and Property in the Occupied Palestinian Territory (OPT) and Continue to Impose a Total Blockade on the Gaza Strip

Three civilians in the West bank and the Gaza Strip sustained bullet wounds when IOF fired at them.

12 civilians, including 2 cameramen, 8 women, sustained injuries and bruises when IOF used force against peaceful demonstrations in the West Bank.

IOF conducted 15 incursions into Palestinian communities in the West Bank, and a one into the Gaza Strip.

IOF arrested 13 Palestinian civilians, including one child, in the West Bank, and a wounded civilian from the Gaza Strip.

Israeli naval troops continued to attack Palestinian fishermen and boats in the Gaza Strip.

IOF have increased measures aimed at creating a Jewish majority in Jerusalem.

Shooting: During the reporting period, three Palestinian civilians suffered bullet wounds following IOF attacks. In addition, 12 Palestinian civilians sustained injuries and bruises after IOF attacks in the West Bank.

Incursions: During the reporting period, IOF conducted at least 15 military incursions into Palestinian communities in the West Bank. IOF arrested 13 Palestinian civilians, including one child.

In the Gaza Strip, on 31 October 2009, an IOF undercover unit moved into the northwest of the ex-settlement of Doghit in the northwest of Beit Lahia to arrest a Palestinian civilian. The civilian was wounded by an IOF attack prior to the arrest.

Restrictions on Movement: IOF have continued to impose a tightened siege on the OPT and imposed severe restrictions on the movement of Palestinian civilians in the Gaza Strip and the West Bank, including occupied East Jerusalem.

Gaza Strip

IOF have continued to close all border crossings to the Gaza Strip for more than two years. The illegal IOF blockade of the Gaza Strip, which has steadily tightened since June 2007, has had a disastrous impact on the humanitarian and economic situation in the Gaza Strip.

1.5 million people are being denied their basic rights, including freedom of movement, and their rights to appropriate living conditions, work, health and education.

The main concern of 1.5 million people living in the Gaza Strip is to obtain their basic needs of food, medicines, water and electricity supplies.

IOF have continued to prevent the entry of raw construction materials into the Gaza Strip for more than two years.

IOF have not allowed fuel supplies into the Gaza Strip, excluding limited amounts of cooking gas, since 10 December 2008.

The Rafah International Crossing Point has been opened for a few days for a number of patients who received medical treatment abroad and needed to return home to the Gaza Strip.

IOF have continued to close Beit Hanoun (Erez) crossing to Palestinian civilians wishing to travel to the West Bank and Israeli for medical treatment, trade or social visits.

Poverty and unemployment rates stand at approximately 80% and 60% respectively in the Gaza Strip.

IOF have continued to prevent the entry of spare parts form water networks and sewage systems. Losses incurred to this sector are estimated at US$ 6 million.

IOF have imposed additional access restrictions on international diplomats, journalists and humanitarian workers seeking to enter the Gaza Strip. They have prevented representatives of several international humanitarian organizations from entering the Gaza Strip.

Living conditions of the Palestinian civilian population have seriously deteriorated; levels of poverty and unemployment are among the highest in the world.

At least 900 Palestinian prisoners in Israeli jails have been denied family visitation rights for more than three years.

IOF have continued to attack Palestinian fishermen along the Gaza Strip coast.

West Bank

IOF have continued to impose severe restrictions on the movement of Palestinian civilians throughout the West Bank, including occupied East Jerusalem. Thousands of Palestinian civilians from the West Bank and the Gaza Strip continue to be denied access to Jerusalem.

IOF have established checkpoints in and around Jerusalem, severely restricting Palestinian access to the city. Civilians are frequently prevented from praying at the al-Aqsa Mosque in Jerusalem.

There are approximately permanent 630 roadblocks, and manned and unmanned checkpoints across the West Bank. In addition, there are some 60-80 'flying' or temporary checkpoints erected across the West Bank by IOF every week.

When complete, the illegal Annexation Wall will stretch for 724 kilometers around the West Bank, further isolating the entire population. 350 kilometers of the Wall has already been constructed. Approximately 99% of the Wall has been constructed inside the West Bank itself, further confiscating Palestinian land.

At least 65% of the main roads that leads to 18 Palestinian communities in the West Bank are closed or fully controlled by IOF (47 out of 72 roads).

There are around 500 kilometers of restricted roads across the West Bank. In addition, approximately one third of the West Bank, including occupied East Jerusalem, is inaccessible to Palestinians without a permit issued by the IOF. These permits are extremely difficult to obtain.

IOF continue to harass, and assault demonstrators who hold peaceful protests against the construction of the Annexation Wall.

Palestinian civilians continue to be harassed by IOF in Jerusalem, and across the West Bank, including being regularly stopped and searched in the streets by IOF.

Measures Aimed at Creating a Jewish Majority in occupied East Jerusalem

During the reporting period, IOF demolished four houses in Beit Hanina, al-Thawri neighborhood and Jabal al-Mukaber village and displaced four families of 34 individuals:

On 1 November 2009, IOF bulldozed the house of Mousa Mashahra, 53, in al-Sala'a neighborhood in Jabal al-Mukaber village, southeast of occupied Jerusalem. A family of six used to live in the house that occupied an area of 50 m² and was composed of two rooms.

On 2 November 2009, IOF bulldozed the house of Majed al-Rajji, 50, in al-'Aqaba neighborhoos in Beit Hanina village, north of occupied Jerusalem. A family of 15 used to live in the house that stood on an area of 100 m² and was composed of three rooms.

Also on 2 November 2009, IOF bulldozed the house of Haroun al-Qawasmi, 61, and the house of Naser al-Shweiki in al-Thawri neighborhood in occupied East Jerusalem. The house of al-Qawasmi, where a family of six used to live, was built 25 years ago. The house where the seven-member al-Shwiki family used to live was owned by Mohammed al-Qawasmi and was built on an area of 80 m².

Settlement Activities: IOF have continued settlement activities in the OPT in violation of international humanitarian law and Israeli settlers have continued to attack Palestinian civilians and property.

On 29 October 2009, IOF bulldozed 14 donums of agricultural lands, including 11 donums that had been reclaimed recently in al-Buqa'a area, east of Hebron. They also demolished 1,000 meters of retaining walls, destroyed more than 300 meters of irrigation networks and destroyed two water collection pools. It should be noted that al-Buqa'a area is one of the most fertile agricultural areas in Hebron. Settlement Road no. 60 passes through the area which is close to "Kiryat Arba'a" and "Kharsina" settlements in the east of Hebron. IOF impose a ban on construction works in al-Buqa'a area and obstruct the delivery of services to the area as part of their plans to force Palestinians to leave their houses and lands, IOF and Israeli settlers repeatedly conduct attacks on civilians in al-Buqa'a area in order to take control of new areas of Palestinian lands by force.

Also on 29 October 2009, IOF delivered notices to four civilians in Kherbat al-Hejri, southwest of Hebron, notifying them of IOF intent to demolish their houses in Kherbat al-Hejri under the pretext of the lack of a building license.

On 30 October 2009, IOF prevented the installation of power networks in al-Tawani village, opposite to "Ma'on" settlement south of Hebron. IOF have banned the establishment of infrastructure in al-Tawani village, including power; water and telephone networks. IOF have also prevented Palestinians in the village from constructing houses. Civilians are forced to live in caves or in shelters that had been established before 1967. Sometimes, Palestinians in the village construct houses without getting building licenses, but IOF later demolish them.

On 31 October 2009, eight settlers from "Brakha" settlement, protected by IOF, raided Iraq Borin village, south of Nablus. Dozens of Palestinian civilians gathered near the southern entrance of the village and stoned the settlers in an attempt to prevent them from entering the village. IOF responded by firing bullets at the Palestinians.

Thursday, 29 October 2009

At approximately 01:00, IOF moved into Beit Ula village, west of Hebron. They raided and searched a number of houses and arrested Abdul Fattah 'Awni Abdul Fattah Farrash, 35.

At approximately 02:00, IOF moved into Taqou'a village, southeast of Bethlehem. They raided and searched a number of houses. Before withdrawing, IOF summoned five Palestinians for interrogation. The summoned civilians are:

1. Ghazi 'Aziz al-Badan, 24;

2. Mousa 'Aziz al-Badan, 22;

3. Fadi Salim al-Badan, 24;

4. Nour Samih al-Badan, 19; and

5. 'Abed Dawood al-Badan,18.

At approximately 02:30, IOF moved into Jaba'a village, south of Jenin. They raided and searched a number of houses, but no arrests were reported.

At approximately 16:00, IOF moved into Saffa village, west of Ramallah. A number of youth gathered and began stoning IOF who responded by firing rubber-coated steel bullets, tear gas canisters and sound bombs. As a result, dozens of Palestinian civilians suffered suffocation as they inhaled gas. Before their withdrawal, IOF arrested Majd Mufid Karaja, 19.

Saturday, 31 October 2009

At approximately 15:00, IOF positioned inside observation towers on the border strip in the northwest of Beit Lahia, northern the Gaza Strip, fired at Ashraf Saleh Salem Jaber, 40, from 'Izbat 'Abed Rabbo in the east of Jabalia town. Jaber was wounded by a bullet to his left foot. Accordign to investigations conducted by PCHR, Jaber was wounded while walking on the beach as he approached the border strip in the northweat of the ex-settlement of Doghit in the northwest of Beit Lahia. His family told PCHR that their son suffers from mental disorder and that he had left the house two days before the incident. After IOF fired at Jaber and wounded him, an IOF undercover unit moved into the scene and transferred Jaber inside Israel. After the International Committee of the Red Cross (ICRC) and the Palestinian Liaison Office managed to make coordination with IOF, Jaber was transferred to Gaza via Beit Hanoun (Erez) crossing and delivered to a Palestinian ambulance. He was then transferred to al-Shifa Hospital in Gaza city where he was diagnosed with severe fractures in his left foot.

Sunday, 1 November 2009

At approximately 01:30, IOF moved into Deir al-Ghsoun village, north of Toulkarem. They raided and searched many houses, but no arrests were reported.

At approximately 02:00, IOF moved into Toulkarem city and into Toulkarem refugee camp. They raided and searched a number of houses, but no arrests were reported.

At approximately 12:00, IOF positioned inside observations towers in Beit Hanoun (Erez) crossing, north of Beit Hanoun in the north of the Gaza Strip, opened fire at Palestinian civilians who were collecting stones from the rubble of the building in the industrial area that had been bulldozed by IOF. IOF also fired a hail of bullets at a tractor belonging to Jaber Younis Mohammed Abu Marshoud, as he was working approximately 150 meters from the border. Abu Marshoud who was driving the tractor escaped from the scene while the tractor was hit by several bullets and has remained in the seen. No casualties were reported in this incident.

At approximately 16:00, IOF moved into Madma village, south of Nablus. IOF fired intensively into the air. A number of boys and children gathers and stone IOF vehicles. Before withdrawing at approximately 22:00, IOF arrested Taher Yousif 'Osa, 18. 'Oda was released late in the night.

At approximately 01:00, IOF moved into Toubas city. They raided and searched many houses. Before withdrawing at approximately 04:30, IOF arrested Nour Addin Hafez Issa Sawafta, 22.

At approximately 01:30, IOF moved into al-Zababda village, southeast of Jenin. They raided and searched many houses. Before withdrawing at approximately 04:30, IOF arrested Mhanna Khaled al-Sharqawi, 32.

Also at approximately 01:30, IOF moved into 'Azzoun village, east of Qalqilia. They raided and searched many houses. Before withdrawing, IOF arrested Qaher Samih Qara'n, 27, and Wisam Sa'id Husein, 16.

At approximately 02:00, IOF moved into 'Azzoun village, east of Qalqilia. They raided and searched many houses. They arrested Husam Mohammed Mousa Slim, 47, and his son Fares, 24.

At approximately 23:00, IOF moved into Toubas. IOF raided and searched a café belonging to Ahmed Daraghmeh. They interrogated a number of the clients. IOF withdrew in the early morning on 4 November 2009. No arrests were reported.

At approximately 00:30, IOF moved into Jenin city. They raided and searched many houses. They withdrew, and no arrests were reported.

At approximately 01:00, IOF moved into Barqin village, west of Jenin. They raided and searched a number of houses. They arrested Mohammed Abdul Karim Yousif Hamdan, 29,

At approximately 02:30, IOF moved into Qalandia refugee camp, north of occupied Jerusalem. They raided and searched the house of 'Oda Shaker Ya'aqoub. They arrested Yousef 'Oda Shaker Ya'aqoub, 18.

At approximately 11:30, IOF gunboats fired several shells at a Palestinian fishing boat which was approximately 300 meters from Rafah port. Belal Mohammed Khalil al-Najja, 23, from the Swedish village, sustained wounds by a bullet to the abdomen. Al-Najjar was transferred to Abu Yousif al-Najjar Hospital in Rafah for treatment. Medical sources described his wounds to be moderate.

2. Continued Blockade of the OPT

Beit Hanoun (Erez) Crossing: IOF have continued to close Beit Hanoun (Erez) crossing for the movement of Palestinian civilians. They have allowed only diplomats, a number of international journalists, workers at international agencies and a few patients who suffer from serious diseases to pass through the crossing. They have continued to prevent Palestinian civilians from visiting their relatives who are detained in Israeli jails. As mentioned above, IOF have allowed a few number of patients to pass through the crossing, but under severe restrictions that include prolonged checking.

Al-Mentar (Karni) Crossing: IOF partially opened the crossing on Monday, 2 November 2009, and allowed the entry of 1,240 tons of wheat (approximately 31 truckloads) and 2,280 tons of fodders (approximately 75 truckloads).

The West Bank

IOF have imposed a tightened siege on the West Bank. During the reporting period, IOF imposed additional restrictions on the movement of Palestinian civilians.

Jerusalem: IOF have continued to impose severe restrictions on the movement of Palestinian civilians to and from the city. Thousands of Palestinian civilians from the West Bank and the Gaza Strip have been denied access to the city. IOF have established many checkpoints around and inside the city. Restrictions of the movement of Palestinian civilians often escalate on Fridays to prevent them from praying at the al-Aqsa Mosque. IOF often violently beat Palestinian civilians who attempt to bypass checkpoints and enter the city. IOF impose severe restrictions on the movement of Palestinian civilians on Fridays to restrict their access to the al-Aqsa Mosque. On Sunday morning, 25 October 2009, IOF reinforced their presence in the old town and in the vicinity of the al-Aqsa Mosque. They erected more checkpoints and stopped and checked Palestinian civilians.

At 13:00 on Wednesday, 28 October 2009, IOF positioned at the "Container" checkpoint, east of al-Sawahra al-Sharqeya village in the southeast of occupied Jerusalem, stopped Berlanti Grace Polis 'Azzam, 21, a student at Bethlehem University. They checked her ID car and saw that she was a resident of the Gaza Strip. They placed her under field interrogation regarding her presence in the West Bank. Then they held her as a first step to take measures to return her to the Gaza Strip. She remained held till 20:00 o'clock. Then IOF handcuffed and blindfolded her. They transferred her by a jeep and then by a police vehicle to the border with the Gaza Strip. She was returned to Gaza via Beit Hanoun (Erez) crossing. She arrived at home at midnight.

According to 'Azzam, she went to live in Bethlehem in 2005 and that she is a student at Bethlehem University. She will graduate from university after two months only. 'Azzam stated to PCHR that when she was held by IOF, she was forced to sit on a metal chair near the checkpoint, after she had been told that she was held because she "lived illegally in the West Bank". While being held by IOF, 'Azzam suffered low blood pressure and weakness in her limbs. In response IOF offered her water and asked her to move her limbs.

She also added:

"At approximately 20:00, a military jeep arrived at the checkpoint. Some female soldiers were in the jeep. One of the female soldiers searched me and searched my bag. They soldiers then handcuffed me. thn they used my shawl to blindfold me. They then transferred me by a jeep. Then they forced me to walk for more than one hour and a half before transferring me by a police car to the border with the Gaza Strip. I was coerced to return to the Gaza Strip via 'Erez' crossing at approximately 23:00. I arrived home at around midnight".

Dina 'Awwad, Director of Public Relations at Bethlehem University, confirmed the statements given by 'Azzam. 'Awwad said that Gisha: the Legal Center for Freedom of Movement (Gisha) in Israel agreed with IOF to refer 'Azzam to Natania detention center so Gisha can meet with her and address her issue. However, Gisha was surprised by the deportation of 'Azzam to the Gaza Strip. 'Awwad pointed out that Gisha submitted a petition to the Israeli Supreme Court to review this issue.

On Thursday afternoon, 29 October 2009, IOF closed Qalandia checkpoint, near the northern entrance of occupied Jerusalem. Eyewitnesses reported that the checkpoint was then very crowded as IOF precisely search the Palestinian passengers.

Nablus: IOF have continued to impose severe restrictions on the movement of Palestinian civilians. IOF troops positioned at an iron gate established on Nablus-Tulkarm road have continued to conduct prolonged checking on Palestinian civilians, especially in the morning. IOF troops positioned at Shavi Shomron checkpoint on the Nablus-Jenin road, and at Za'tara checkpoint, south of the city, have also continued to restrict the movement of Palestinian civilians.

At approximately 14:00 on 1 November 2009, three IOF soldiers who came from "Yetshar" settlement severely beat Ma'amoun Amin Fayez Nassar, 34, from Madma village, south of Nablus. Then the IOF soldiers arrest Nassar and transferred him to Belenson Hospital in Tel Aviv. Nassar was grazing his sheep in al-Rasem area, near "Yetshar" settlement", approximately 500 meters far from house in Madma village.

Amin Fayez Mohammed Nassar, 67, is the father of Ma'amoun. He stated to the PCHR fieldworker that:

"At approximately 14:00 on Sunday, 1 November 2009, I was near my house between Madma village and 'Asira al-Qeblia village. In the meanwhile, I heard firing. I phoned to my son Ma'amoun, 34, who was grazing sheep in al-Rasem area, near "Yetshar" settlement", approximately 500 meters far from our house. He told me that he was fired at by the Israeli occupation soldiers. He also told me that they were walking to him. I immediately asked my sone; Ayman, 42, Mohammed, 32, and Amir, 24, to join me to al-Rasem area to bring their brother. When I was approximately 50 meters far from Mahmoud, I could see that he was bleeding from his head. His face was covered with blood. The three soldiers were carrying him. I then saw three military jeeps coming from Huwwara checkpoint to the scene. When the jeeps arrived, soldiers stepped down. We were only 15 meters far from Ma'amoun. They pointed their guns at us and prevented us from approaching. One of the soldiers asked Ma'amoun in Hebrew, that I understand well: 'Did the soldier beat you?' he replied 'yes'. They interrogated him for short moments and then they tied his legs and carried him to one of the jeeps. They asked me and my sons to return home. I called to the ICRC and to a number of Palestinian and Israeli human rights and reported what happened to them. I later got a phone call from Yesh Din for Human Rights in Israel. They told me that my son was transferred from Huwwar detention center to Belenson Hospital as he was severely beaten. Since then, I received no information about him."

Hebron: IOF have continued to impose severe restrictions on the movement of Palestinian civilians inside and around Hebron. IOF also extended the imposition of closure on streets in the southeast of Hebron according to a new military order.

On 29 October 2009, IOF erected a checkpoint on Wasdi Sa'ir street, northeast Hebron, arrested Khader Shakib al-'Eweiwi, 26, from Hebron.

On Monday morning, 2 November 2009, IOF issued a military order to extend the closure imposed on Haret Jaber street that leads to the al-Haram al-Ibrahimi for six month starting on the date of the order. According to data collected by PCHR, on 2 November 2009, IOF officers delivered the new military order to Palestinian civilians in al-Ras area, east of Hebron. This closure is alleged to "ensure security for the Israeli Defense forces in the area".

It should be noted that this imposition of closure affects Palestinians in al-Ras area, Haret Jaber and wasi al-Hasin through which the closed street passes.

Jenin: IOF have continued to impose severe restrictions on the movement of Palestinian civilians. On Thursday morning, 29 October 2009, IOF erected two checkpoints at the entrances of Jaba'a village and Sanour village, and erected a third checkpoint on Jenin-Nablus road. They stopped and searched Palestinian civilian vehicles.

At approximately 06:00 on 29 October 2009, IOF positioned at al-Hamra checkpoint in the east of Jenin arrested Nadal Abdul Ra'ouf Mohammed Sabbah, 22, from Barqin village, west of Jenin. Sabbah was on his way to Jericho when IOF soldiers positioned at al-Hamra checkpoint checked his ID car and handcuffed him.

3. Construction of the Annexation Wall

IOF have continued to construct the Annexation Wall inside West Bank territory. During the reporting period, IOF used force against peaceful demonstrations organized by Palestinian civilians and international and Israeli human rights defenders to protest the construction of the Wall.

According to Abdullah Abu Rahma, spokesman of the Palestinian Anti-Apartheid Wall Campaign in Bal'ein, Following the Friday Prayer on 30 October 2009, dozens of Palestinian civilians and international and Israeli peace activists and human rights defenders gathered in the center of Bal'ein village, west of Ramallah. They moved towards the Wall and following provocation threw stones at IOF troops positioned in the area. Immediately, IOF troops fired rubber-coated metal bullets, sound bombs and tear gas canisters at the demonstrators. Dozens of demonstrators suffered from tear gas inhalations.

Also following the Friday Prayer on 30 October 2009, and according to data made available by the Palestinian Anti-Apartheid Wall Campaign in Ne'lin, dozens of Palestinian civilians and international and Israeli human rights defenders organized a peaceful demonstration in Ne'lin village, west of Ramallah, in protest to the construction of the Annexation Wall. They clashed with IOF troops positioned near the Wall. IOF troops fired rubber-coated metal bullets, sound bombs and tear gas canisters at demonstrators. As a result, Dozens of demonstrators suffered from tear gas inhalations.

Also following the Friday Prayer on 30 October 2009, dozens of Palestinian civilians and international human rights defenders organized a peaceful demonstration to protest the construction of the Annexation Wall in al-Ma'sara village, south of Bethlehem. Israeli troops closed the entrance of the village and attacked the demonstrators. They fired sound bombs and tear gas canisters at the demonstrators. IOF beat some of the demonstrators. A child, Zeid Mohammed Zawahra, 17, was wounded in his right hand. In addition, three demonstrators suffered from tear gas inhalations.

4. Measures Aimed at Creating a Jewish Majority in Occupied East Jerusalem

IOF has recently escalated arbitrary measures against Palestinian civilians in East Jerusalem to force them to leave the city. PCHR has devoted this section in the Weekly Report to highlight violations of human rights perpetrated by IOF against Palestinian civilians in East Jerusalem.

On Sunday morning, 1 November 2009, IOF raided al-Sala'a neighborhood in Jabal al-Mukabber village, southeast occupied Jerusalem. IOF besieged the house of Mousa Suleiman al-Mashahra, 53. IOF bulsozers started demolishing the house. The house, in which a family of six members used to live, was built on an area of 50 m2 and was comprised of two rooms. It should be noted that al-Mashahra built the house in 2000. In beginning 2006, the Israeli Municipality of Jerusalem notified al-Mashahra it was essential to demolish the house under the pretext of lacking building license. Less that six months ago, the Municipality delivered an administrative order to al-Mashahra to demolish the house. The family managed, through their lawyer, to postpone the demolition until the beginning of the current month. However, the Municipality demolished the house as soon as the time give to the family was over.

On Monday morning, 2 November 2009, IOF raided al-'Aqabeh neighborhood in Beit Hanina village, north of occupied Jerusalem. IOF besieged the house of Majed Mohammed al-Rajji, 50. IOF members raided the house and forced the family to leave the house. Then IOF bulldozers demolished the house completely. The house, where a family of 15 used to live, was built on an area of 100 m2 and was comprised of three rooms.

The al-Rajji family built their house in 2000. In 2003, the Israeli Municipality of Jerusalem visited the house and delivered the family a notice to pay a fine of 40,000 NIS. The family paid the fine. After the demolition, it was found out that the court of the Israeli Municipality of Jerusalem issued an administrative order to demolish the house on 1 November 2009; i.e., one day before the implementation of the order. The family was not notified with the order and thus did not have the opportunity to appeal against it.

At approximately 07:38 on 2 November 2009, IOF raided al-Thawri neighborhood in occupied East Jerusalem. IOF closed the surroundings of the house of Haroun Isma'il al-Qawasmi, 61. IOF members forced the six-member family to leave their house. They took some furniture out of the house; bulldozers began demolishing the house at 08:00. The house which occupied built on an area of 70 m2 was built 25 years ago. Six months ago, al-Qawasmi family received an administrative order to demolish their house.

The same IOF troop that demolished the house of Haroun Isma'il al-Qawasmi walked to the house of Naser al-Shweiki, 50, in al-Thawri neighborhood. They forced the al-Shweiki family to leave the house. IOF bulldozers then demolished the house under the pretext of the lack to a building license. The house, where a family of seven members used to live, occupied more than 100 m2. It is owned by Mohammed Jada'a al-Qawasmi.

5. Settlement Activities and Attacks by Settlers against Palestinian Civilians and Property

IOF have continued settlement activities in the OPT in violation of international humanitarian law, and Israeli settlers have continued to attack Palestinian civilians and property.

On Thursday morning, 29 October 2009, IOF bulldozed agricultural lands in al-Buqa'a area, east of Hebron. As Palestinian farmers tried to prevent IOF from bulldozing their lands, IOF beat them and fired sound bombs and tear gas canisters at them. Twelve Palestinians, including two cameramen and eight women, sustained bruises and suffered gas inhalation. IOF declared the area a closed military zone and bulldozed 14 donums of agricultural land, including 11 donums that had been recently reclaimed. They also demolished 1,000 meters of retaining walls, destroyed more than 300 meters of irrigation networks and destroyed two water collection pools.

Seven of the wounded Palestinians were evacuated to hospital by ambulances from the Palestinain Red Crescent Society. These civilians are:

1. Abdul Hafiz Deyab al-Hashlamon, 36, a cameraman, who suffered gas inhalation and bruises in the shoulder;

2. Najah Fadel Jaber, 47, who sustained a wound in the face and bruises in the right shoulder;

3. Freiha Salim Jaber, 55, who sustained bruises throughout the body;

4. Rudeina Bader Jaber, 48, who suffered gas inhalation and bruises in the chest;

5. Ibtesam Rashed Jaber, 45, who suffered gas inhalation;

6. Amna Abdul Jawwad Jaber, 72, who suffered gas inhalation; and

7. Izdihar Fallah Jaber, 50, who sustained gas inhalation and bruises in the chest and the back.

The rest of the wounded, who received first aid in the field, are:

1. Kawkab Jaber;

2. Mer'i Jaber;

3. Badran Jaber;

4. Abdul Jawad Jaber; and

5. Najeh al-Hashlamon, a cameraman.

Badran Jaber and 'Ata Jaber, are amongst the owners of the destroyed properties. They stated to PCHR that IOF continued bulldozing works till 13:00 o'clock and that they bulldozed 14 donums of agricultural land, including 11 donums that had been reclaimed recently. They also explained that IOF also demolished 1,000 meters of retaining walls, destroyed more than 300 meters of irrigation networks and destroyed two water collection pools. The destroyed properties belong to Mohammed Mustafa Jaber, Badran Jaber, 'Ata Jaber, Badwan Badawi al-Rajji, Samih 'Arif al-Rajji, and Fouzan Badwan al-Rajji.

It should be noted that al-Buqa'a area is one of the most fertile agricultural areas in Hebron. Settlement Road no. 60 passes through the area which is close to "Kiryat Arba'a" and "Kharsina" settlements in the east of Hebron. IOF impose a ban on construction works in al-Buqa'a area and obstruct the delivery of services to the area as part of their plans to force Palestinians to leave their houses and lands, IOF and Israeli settlers repeatedly conduct attacks on civilians in al-Buqa'a area in order to take new areas of Palestinian lands by force.

Also on 29 October 2009, IOF delivered demolition notices to four civilians in Kherbat al-Hejri, southwest of Hebron, under the pretext of the lack of building licenses. The four civilians are: Jamal Ibrahim al-Rjoub, Khaled Abu Mqadam, Samir Mohammed Issa Dodein, and Mahmoud Mohammed Issa Dodein.

On Friday morning, 30 October 2009, IOF prevented the installation of power networks in al-Tawani village, opposite to "Ma'on" settlement south of Hebron. According to local sources and to statements of international solidarity activists who live in the village, officers from the Israeli "Military Liaison Office" stopped the installation of power networks in al-Tawani village. They also arrested a Palestinian worker from al-Dhahereya village. IOF released the worker later but confiscated his equipment. The confiscated equipment included a lorry, an automatic ladder and a large roll of electric wires. On 22 July 2009, officers from the Israeli "Military Liaison Office" issued an order to remove six power stations from the village. Further, on 25 May 2009, these officers, with an IOF troop, raided the village to stop the establishment of eight power stations in the village.

According to PCHR investigations and statements by Suleiman Mohammed al-'Adra, a Palestinian from al-Tawani village, IOF have banned the development of infrastructure in al-Tawani village, including power; water and telephone networks. IOF have also prevented Palestinians in the village from constructing houses. Civilians are forced to live in caves or in shelters established before 1967. Sometimes, Palestinians in the village are forced to construct their house without getting building license; IOF later demolish the structures.

On Saturday evening, 31 October 2009, eight settlers from "Brakha" settlement, protected by IOF, raided Iraq Borin village, south of Nablus. Dozens of Palestinian civilians gathered near the southern entrance of the village and stoned the settlers in an attempt to prevent them from entering the village. IOF responded immediately by firing bullets and tear gas canisters at the Palestinians. As a result, Sa'ad Husam Faraj Qadus, 24, was injured when he was hit by a tear gas canister to his abdomen. Before withdrawing, IOF arrested Wa'el Hamza Faraj Qadous, 41.

Recommendations to the International Community

1. PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to fulfill their legal and moral obligations under Article 1 of the Convention to ensure Israel's respect for the Convention in the Occupied Palestinian Territory. PCHR believes that the conspiracy of silence practiced by the international community has encouraged Israel to act as if it is above the law and encourages Israel continue to violate international human rights and humanitarian law.

2. PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to convene a conference to take effective steps to ensure Israel's respect of the Convention in the OPT and to provide immediate protection for Palestinian civilians.

3. PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to comply with its legal obligations detailed in Article 146 of the Convention to search for and prosecute those responsible for grave breaches, namely war crimes.

4. PCHR calls for the immediately implementation of the Advisory Opinion issued by the International Court of Justice, which considers the construction of the Annexation Wall inside the West Bank illegal.

5. PCHR recommends international civil society organizations, including human rights organizations, bar associations and NGOs to participate in the process of exposing those accused of grave breaches of international law and to urge their governments to bring these people to justice.

6. PCHR calls upon the European Union to activate Article 2 of the Euro-Israel Association Agreement, which provides that Israel must respect human rights as a precondition for economic cooperation between the EU states and Israel. PCHR further calls upon the EU states to prohibit import of goods produced in illegal Israeli settlements in the OPT.

7. PCHR calls on the international community to recognize the Gaza disengagement plan, which was implemented in September 2005, for what it is - not an end to occupation but a compounding of the occupation and the humanitarian crisis in the Gaza Strip.

8. In recognition of ICRC as the guardian of the Fourth Geneva Convention, PCHR calls upon the ICRC to increase its staff and activities in the OPT, including the facilitation of family visitations to Palestinian prisoners in Israeli jails.

9. PCHR appreciates the efforts of international civil society, including human rights organizations, bar associations, unions and NGOs, and urges them to continue their role in pressuring their governments to secure Israel's respect for human rights in the OPT and to end its attacks on Palestinian civilians.

10. PCHR calls upon the international community to pressure Israel to lift the severe restrictions imposed by the Israeli government and its occupation forces on access for international organizations to the OPT.

11. PCHR reiterates that any political settlement not based on international human rights law and humanitarian law cannot lead to a peaceful and just solution of the Palestinian question. Rather, such an arrangement can only lead to further suffering and instability in the region. Any peace agreement or process must be based on respect for international law, including international human rights and humanitarian law.

Obama’s Prize tells world ‘War is Peace’ by Cal Colgan

Last month, Barack Obama became the third U.S. president to receive the Nobel Peace Prize. The Norwegian Nobel Committee lauded Obama for his "extraordinary efforts to strengthen international diplomacy and cooperation between peoples."

But unlike the countless followers of the lunatic Glenn Beck who think our 44th president is turning our country into Stalinist Russia, there is a more rational argument to be made against Obama’s recent award.

The Nobel Peace Prize was given to a man who, like a character in a George Orwell novel, kills in the name of peace. And as much as his doublespeak would like to drown out the cries of the victims of the sinister cadre of human rights abusers and war criminals that he supports, anyone with an elementary knowledge of current events knows that Obama’s hands are muddied by the muck his allies have thrown on the peoples of the world.

Obama’s congratulations of Afghan president Ahmed Karzai’s reelection at the beginning of this month came along with his stern declaration that Karzai must take "a much more serious effort to eradicate corruption" in the country. Yet Karzai’s very election campaign was mired with fraud, with his main rival, Abdullah Abdullah, dropping out of the race because of doubts that any attempt at a runoff would be free of tampering by Karzai’s campaign officials.

Life for Afghan civilians under Karzai’s rule is so deplorable that women continue to burn themselves to death rather than live under a patriarchal society in which they have no rights.

Democracy activists like Malalai Joya have survived several assassination attempts for speaking out against the Karzai government’s human rights abuses and opium trafficking.

As of this writing, Obama is considering whether to send an additional 40,000 to 60,000 troops to a country that is run by a mirror image of the terrorists and theocracy-supporters that the U.S. military is fighting. More than 1,500 American soldiers have already died in Afghanistan, and countless Afghan civilians have been killed.

But Obama still thinks democracy and peace can be won by assault rifles and depleted uranium.

Although the Nobel Committee paints Obama as a dove of peace, within the first month of his presidency, he invaded Pakistan. The U.S. military’s efforts to annihilate the Taliban in Pakistan have resulted in 2 million displaced Pakistani civilians and countless dead.

Although Pakistani government officials have chastised the U.S. for violating the country’s sovereignty, Obama will stop at nothing to accomplish his goal of destroying the Taliban – even if it means another military quagmire like Iraq.

As much of a dove that the Nobel Committee claims Obama is, within the first month of his presidency, he invaded Pakistan. The U.S. military’s efforts to annihilate the Taliban in Pakistan have resulted in 2 million displaced Pakistani civilians and countless dead. Although Pakistani government officials have chastised the U.S. for violating the country’s sovereignty, Obama will stop at nothing to accomplish his goal of destroying the Taliban – even if it means another military quagmire like Iraq.

The relationship between the Obama administration and Israel raises the question of which country has more influence over the other. In January of this year, the Israeli government bombed the Gaza strip, killing 1400 Palestinians.

A U.N. fact-finding commission on the Gaza conflict headed by Justice Richard Goldstone determined that Israel’s attack on Palestinians were disproportional to the number of Israelis Hamas killed. What’s worse, the report found that the majority of the Palestinians that were killed in the conflict were civilians, including women and children. The Goldstone Report wanted a war crimes investigation of both the Israeli government and Hamas.

But the U.S. Congress called the Goldstone Report "pre-judged" and "one-sided," and Obama has done nothing to defend the U.N. commission. Obama previously chided Israel on its ruthless pursuit of establishing illegal Jewish settlements in the West Bank, saying that Israel must stop all settlement building before negotiations resume between Israeli and Palestinian leaders. Secretary of State Hillary Clinton, however, recently declared that the Obama administration has reversed its policy, effectively kowtowing to its law-breaking buddy.

You would think Obama would at least try to compensate for his warmongering and support of bloodthirsty and vindictive foreign governments by rolling back the fascistic policies of the Bush administration.

You would be wrong.

Although Congress has recently passed a bill that modifies some of the more draconian tactics the military commissions system uses at Guantanamo Bay like coerced testimony and restrictions on prisoners’ accesses to eyewitnesses, prisoners at Guantanamo are still tried by the military and not by a jury of their peers. During his election campaign, Obama declared the eventual closing of Guantanamo Bay. And yet the American prison in Cuba remains, still holding more than 220 detainees, many of whom were never formerly charged with being "enemy combatants."

And Big Brother still infringes upon the rights of American citizens with the PATRIOT Act. The Senate recently rejected an amendment to the law that would stop the surveillance of individuals with no links to terrorist groups.

As the Obama administration asked the Senate to continue these measures, it is doubtful that Obama will have any objection to the Federal Government’s trampling on the Bill of Rights.

The Norwegian committee awarded Obama the Nobel Peace Prize in the hope that the award will give him the incentive to promote peace across the globe. But our president’s support of corrupt human rights abusers and war criminal foreign governments, as well as his endorsement of Bush-era policies at home, raise doubts that Obama will be a savior.

But perhaps the scariest aspect of Obama’s so-called "peace" record is that for all of his military bullying, liberals will continue to support him, and conservatives will continue to hope that he becomes more like Bush.

It seems like the conservatives are going to get their wish.

November 6, 2009 HERAT, Afghanistan (Reuters) - More than 25 NATO and Afghan troops were wounded during a search Friday for two missing U.S. paratroopers in western Afghanistan, the NATO-led force said. The Taliban said the two missing soldiers were dead and it had recovered their bodies. A statement by the International Security Assistance Force in Afghanistan said more than 25 troops were wounded during a search and rescue mission. Lieutenant Darin Russell, a spokesman for NATO forces, said the troops were wounded "by insurgent activity." He declined to give further details of the incident, which he said was under investigation. He was unable to say how many of the wounded were NATO troops and how many were Afghans, or whether any of them had been killed. The chief of police in Badghis province in western Afghanistan, Abdul Jabar, said NATO aircraft had struck their own troops during the search and that several Americans had died in the "friendly fire" air strike. NATO announced earlier Friday that two U.S. paratroopers from the 82nd Airborne Division had gone missing Wednesday while delivering supplies. Reports of missing troops in Afghanistan are extremely rare and would automatically trigger a large-scale military response. A Taliban spokesman, Qare Yousuf, told Reuters by telephone from an undisclosed location that the two missing soldiers had drowned and the Islamist militants had recovered their bodies. Jabar also said the two missing U.S. soldiers had drowned. U.S. Navy Captain Jane Campbell, a spokeswoman for the NATO-led force, said: "We continue exhaustive search and rescue operations to locate our missing service members. We are doing everything we can to find them." "The families of these service members have been notified about their loved ones' status, and we will continue to keep them informed as information becomes available." Troops from more than 40 nations are members of the nearly 110,000-strong force, two-thirds of them American. Badghis is one of several provinces in the previously quiet west and north of Afghanistan, where insurgent activity has increased dramatically in recent months. A U.S. soldier has been missing in the southeast since late June. Insurgents say they are holding him, and U.S. forces in the area launched a massive manhunt. Why Ugandans want to work in Iraq By Joshua Mmali, BBC News

At the Watertight security training ground in Uganda, a group of men and women are doing target practice with their AK47s.

Nearby, another group are listening to a lecture under the shelter of a tree.

Watertight Security Services has been sending Ugandan security guards to Iraq since 2007.

So far, more than 10,000 Ugandans have gone to work in the country.

When I came back, I bought land and cows. All that money came from Iraq.

Moses Matsiko worked in Iraq for more than three years before returning to Uganda to set up the company.

"Since we do security, we start by screening the criminal background of people, hand in hand with Interpol," he told the BBC World Service.

"Then we do a medical screening to make sure that the people we are sending are medically fit.

From there we start a training programme which entails weapon handling, shooting range drills and first aid."

Applicants outnumber available places by more than 1,000.

Land of opportunity

Seth Katerema Mwesigye, an instructor at Watertight, says the money has made him wealthy by Ugandan standards.

"I was a student at Makerere university, but when I left, I did not have land. When I came back, I bought land and cows. All that money came from Iraq."

Mr Masiko says that Iraq has proved to be a lucrative opportunity for security firms and their Ugandan recruits.

But he says the company now needs to stay ahead of the increasing competition in the security sector and look for opportunities in new places.

"More companies are coming in and they are ready to recruit for much less than we are offering which is $700 or $1,000 (£600) per month," he says.

"Also you realise that other countries are coming into the market on the other side.

"Originally Kenyans were not doing security work but today, there are more than 500 of them in Iraq and they work for as little as $400 per month.

"So we are facing competition.

"But all eyes are now on Afghanistan. We hope that as it opens we are going to get more business there," he says.

But the picture is not all rosy.

As well as the obvious danger of going to Iraq, there have been numerous stories recently in the Ugandan media about disaffected workers with complaints about conditions and pay.

Some of them want to return home.

Labour, Gender and Social Affairs Minister Gabriel Opiyo admits that not all of these companies have been treating their workers fairly.

"They must conform to the regulations which they signed up to when they got their licence, otherwise we will withdraw their licence," he says.

"We are in the process of developing employment policies which will include a minimum wage."

It is obvious that the recruits at Watertight Security Services are desperate to escape from the poverty and unemployment that define their lives in Uganda.

With hope, soon they will be marching into a future that will bring them rich rewards.

Awatef Al-Assar filled bags of sand to hold down the sides of the tent in a failed attempt to stabilise it. Her children still remember how hard she tried to hold on to the pole of the tent that was sheltering her and her family last winter as the winds blew hard to uproot it. Meanwhile, trying to help, her husband was shaking with cold and fear from the thunder outside. Rainwater swamped the tent as their efforts failed and the tent collapsed on the heads of the children. The entire family was forced to seek refuge at a nearby house.

Like thousands of others, Al-Assar's home was destroyed during Israel's war on the Gaza Strip. Even now she fears a repeat of the same punishing experience of last winter. Her neighbour, Hajja Fatma Hamdan, who is at the same refuge camp with her family, remembers how she was surprised by the amount of rain filling up the tent while her family slept. They awoke startled, and all they could do was abandon all their possessions and seek shelter elsewhere.

The residents of the refuge camp, which lies close to Beit Lahia, said that uprooted and torn tents resulted in many health problems for the homeless, especially children. The young suffer from vomiting, diarrhoea and stomach cramps. Nehaya, who was widowed when her husband was killed during the war, said that for a long time she was continuously taking her children to a clinic in Beit Lahia for severe cases of colds.

As winter approaches, the occupants of this camp -- like those in other camps -- complain that there are not enough warm blankets. Suleiman Al-Masri, whose home in Beit Hanoun in northeastern Gaza was destroyed, said his family of 15 only received seven blankets from a charity organisation. Nine months after the end of the war, many homeless families still return to their destroyed homes in search of more blankets and warm covers under tons of rubble. Most of these attempts end in failure, either because everything inside is scorched or is buried too deep in the debris.

These families have no refuge except the camps set up by the Hamas government, UNRWA or charities working in Gaza. Camps for those who lost their homes have become widespread in Gaza. In fact, camps were constructed in every area destroyed during the war.

While those whose homes were completely demolished during the war suffer the winter cold, those whose homes were not completely obliterated during the assault also suffer. Windowpanes need to be replaced in many homes to block the bitter cold of winter, but because of the siege the supply of glass is limited and only available via smuggling. This has raised the price of glass unreasonably. The windows of Ghassan Abu Samha's family home, located in Al-Maghazi Refugee Camp in the centre of Gaza, were destroyed by the Israeli onslaught. The eight members of his family will be exposed to the winter chill as the cold season approaches and no repairs have been possible.

Abu Samha told Al-Ahram Weekly that he could not afford to repair the windows with the available glass, which is of poor quality anyway. "It costs 2,500 shekels [$700] to repair, which is a huge sum for me," he continued. "I have no other choice but to cover the windows with plastic which doesn't cost more than 100 shekels." Abu Samha's 10- year-old son Ahmed remembered how he could hardly sleep last winter because of the plastic on his bedroom window. Nonetheless, using plastic to cover broken windowpanes has become the common remedy for many families in Gaza.

Meanwhile, hundreds who live on the border between Israel and the Gaza Strip, and whose homes are intact, have decided to leave out of fear of being bombed by Israel. They feel especially vulnerable because their homes are located opposite Israeli army bases on the demarcation line.

Zaidan Sarar, who lives in Om Al-Gamal on the border, is one of those who chose to leave their home and move to a rented apartment out of fear of the Israeli army. Sarar moved to an apartment block in Deir Al-Balah and abandoned his home, telling the Weekly he preferred spending all his income on rent rather than risk his safety. "When I recalled the corpses of children who were killed in the last war, I decided to do anything so my children don't suffer the same fate," he said. "This is why I sought to rent an apartment and leave my home which I spent all my life's savings to build."

Other families are grappling with overcrowding after opening their doors to homeless families. Gamal Al-Masri, 29, waits until night before returning to his home in Al-Nosayrat Refugee Camp in the centre of Gaza. Al-Masri's home currently accommodates his parents and younger siblings who sought him out after their home in Al-Maghazi Camp, east of Al-Nosayrat, was obliterated in the last war in Gaza. Al-Masri, who is married with five children, told the Weekly that he tries to spend as much time outside the house as possible because his three-bedroom home now houses 17 people. As winter approaches, his ability to stay out with co-workers or neighbours is diminishing, but he is still unable to live in the overcrowded house. Al-Masri's biggest problem is a shortage in warm covers to shield everyone from the harsh winter cold.

Al-Masri is not the only one who was obliged to take in his family after the Israeli army destroyed their homes during the war. In fact, he could be considered luckier than most who have had to house many more family members because of the war. Adel Sala, 43, had no choice but to take in two of his brothers' families after the Israeli army destroyed their homes in two separate air attacks. With 25 people now living in his four-bedroom house in Al-Qarara village, each room houses one family while the three men sleep in the fourth room. Sala admits that the living conditions are very difficult, complicated and awkward. For example, going to the bathroom requires prior scheduling, while he and his brothers go to the mosque for ablutions to avoid any embarrassment.

The scenes of hardship this winter are endless, not least of the children whose homes were demolished and had to move far away from their areas of residence. Now they must commute for long distances to reach their schools and also lack sufficient winter clothing to protect them against the bitter winter cold.

The Etiquette of Women Walking in the Street by Imam Ibn Katheer
Allah's saying: [وَلاَ يَضْرِبْنَ بِأَرْجُلِهِنَّ] (And let them not stamp their feet...) During Jahiliyyah, when women walked in the street wearing anklets and no one could hear them, they would stamp their feet so that men could hear their anklets ringing. Allah forbade the believing women to do this. By the same token, if there is any other kind of adornment that is hidden, women are forbidden to make any movements that would reveal what is hidden, because Allah says: [وَلاَ يَضْرِبْنَ بِأَرْجُلِهِنَّ] (And let them not stamp their feet...) to the end of it. From that, women are also prohibited from wearing scent and perfume when they are going outside the home, lest men should smell their perfume. Abu `Isa At-Tirmidhi recorded that Abu Musa, may Allah be pleased with him, said that the Prophet said: «كُلُّ عَيْنٍ زَانِيَةٌ، وَالْمَرْأَةُ إِذَا اسْتَعْطَرَتْ فَمَرَّتْ بِالْمَجْلِسِ فَهِيَ كَذَا وَكَذَا» (Every eye commits fornication and adultery, and when a woman puts on perfume and passes through a gathering, she is such and such) -- meaning an adulteress. He said, "And there is a similar report from Abu Hurayrah, and this is Hasan Sahih.'' It was also recorded by Abu Dawud and An-Nasa'i. By the same token, women are also forbidden to walk in the middle of the street, because of what this involves of wanton display. Abu Dawud recorded that Abu Usayd Al-Ansari said that he heard the Messenger of Allah , as he was coming out of the Masjid and men and women were mixing in the street, telling the women: «اسْتَأْخِرْنَ فَإِنَّهُ لَيْسَ لَكُنَّ أَنْ تَحْقُقْنَ الطَّرِيقَ، عَلَيْكُنَّ بِحَافَّاتِ الطَّرِيقِ» (Keep back, for you have no right to walk in the middle of the street. You should keep to the sides of the road.) The women used to cling to the walls so much that their clothes would catch on the walls. [وَتُوبُواْ إِلَى اللَّهِ جَمِيعاً أَيُّهَ الْمُؤْمِنُونَ لَعَلَّكُمْ تُفْلِحُونَ] (And all of you beg Allah to forgive you all, O believers, that you may be successful.) means, practice what you are commanded in these beautiful manners and praiseworthy characteristics, and give up the evil ways of the people of Jahiliyyah, for the greatest success is to be found in doing what Allah and His Messenger command and avoiding what He forbids. Emir Hakimullah Mehsud (may Allah Protect him) All Praise is for Allah who created all to worship Him. May peace and blessings be upon Messenger of Allah. To proceed... “And I created not the jinn and mankind except that they should worship Me (Alone).” [Adh-Dhariyat: 56] Honorable listeners, The purpose of mankind has been described by Allah, Splendid is His Majesty, in the Qur'an: “And I created not the jinn and mankind except that they should worship Me (Alone).” [Adh-Dhariyat: 56] And for this work, Allah, the Most Pure, sent the Prophets (salutations and blessings be upon them) whose purpose was to bring mankind to this straight path. On Allah's lands, establishing Khilafah is mankind's responsibility. For this responsibility, Allah, the Most Pure, sent Muhammad, the Arab, (peace and blessings be upon him) as a medium of Hidayah (Guidance) for the world. To him (peace and blessings be upon him), Allah, Splendid is His Majesty, gave the Qur'an. Qur'an is that Book which is uncertain and suspicious only to a kaffir. In the Qur'an, Allah, Splendid is His Majesty, says to the Prophet (salutations and blessings be upon him): “O Prophet! Urge the believers to fight.” [Al-Anfal: 65] He (peace and blessings be upon him) urged the believers to Qital (fight) and gave the invitation to Qital. In this series of invitations, he (peace and blessings be upon him) fought in battles himself where his teeth also broke, and in many battles his Companions presented sacrifices. The purpose of those sacrifices was to elongate Allah's Hukm. Because Allah, Splendid is His Majesty, says: “Fighting is ordained for you.” [Al-Baqarah: 165] Likewise Allah, Lord of the Universe, has said: “Fasting is ordained for you.” [Al-Baqarah: 183] So in the same way Allah has prescribed fasting, He, Splendid is His Majesty, has prescribed Qital for Mu'mineen and Muslims. So the Companions presented many sacrifices, the purpose of which was to extend Allah's Hukm. My dear brothers, Jihad becomes an obligation on Muslims due to a few reasons. Respected Ulema has a united fatwa that if a 1-meter land comes under the dominion of kuffar, then Jihad becomes a fard-al-'ayn on Muslims. In today's times, 1-meter land is far off; instead the entire Muslim Ummah is under the control of kuffar. Afghanistan, Kashmir, Iraq, Palestine, Chechnya: Muslims' women, children, elderly, and youth are confined in kuffar's prisons. Dr. Afia Siddique, our Muslim sister, is shackled in America's prisons, imprisoned by the kuffar. In this regard, if we seek a fatwa from the Ulema, then the Ulema-e-Haq will certainly give a fatwa involving Jihad. Honorable listeners, It is being conceived today that we are Taliban/country's enemies and outsider's agents. But in no way is this the reality. We are not the country's enemies and outsider's agents. We are children of this Pakistani nation. Pakistani nation is with us and we are with them. History testifies to the fact that tribes like us have presented sacrifices for Pakistan and Azad Kashmir. Today, we are labeled as foreigners and agents, but this is not true on any account. Moreover, Waziristan and Swat, Bajaur, Mehmund, Aurakzai, Dara Adamkhel, Jamia Hafsa, and Lal Masjid are razed by the army on American signal and this is referred to as the 'safeguarding' of the country. But when, maintaining Allah's Akhamaat, we preserve and present our lives and wealth, protect our Ulema,... alas! we are referred to as 'foreigners.' We appeal the intellectual people of Pakistan that they come and sit among us, and decide in front of Pakistani nation that who is the agent of outsiders? Us or the Pakistani government? Now I return to addressing the Pakistani army; why do we fight them? Regarding Pakistani army, majority of the people have uncertainties but Allah, Lord of the Universe, says in the Glorious Qur'an: Allah, Splendid is His Majesty, instructs the Muslims: “O ye who believe! Take not the Jews and the Christians for your friends and protectors: They are but friends and protectors to each other. And he amongst you that turns to them (for friendship) is of them. Verily Allah guideth not a people unjust.” [Al-Mai'dah: 51] In the war against Pakistani army, we have two aims for it. First is to end its support of America; to abdicate the contracts with America. Second is to bring a Shari'ah system inside Pakistan. These are our objectives. We are not the enemies of Pakistan and Pakistani nation. Instead we are enemies of this current kufr, democratic system that has been subdued on us. This system is unjust and despotic. This unethical and tyrannical setup is a kufr system irrelevant to Shari'ah. It is the same system, under whose shadow, Dr. Afia Siddique was sold to America in exchange for dollars. It is the same system whose disbeliever is held in contempt regardless of him being a respectable Pakistani citizen. An example is Dr. Abdul Qadeer. His crime was the creations of atomic bomb and missiles in order to defend an Islamic country. After disgracing and sending him in prison, it was referred to as safeguarding the nation's interests. Keep in mind that this is not in the nation's interests: it is being done to please America. If we ask the Pakistani nation: who is the honorable citizen of the country? Musharraf or Dr. Abdul Qadeer? Zardari or Dr. Abdul Qadeer? The entire nation will indeed respond that Dr. Abdul Qadeer is the honorable citizen of the country. So why is such a person debased and scandalized? It is the same system that disregarded any diplomatic courtesy while degrading Mullah Abdul Salaam Zaeef and handing him over to America. So the guardians of this system, army institutions, police, militia, and any protector who guards it; we will fight against them until a just system is established in Pakistan Insha'Allah. If the government of Pakistan abandons the contracts with America and announces a Share'e system in Pakistan, then we will no longer be its enemy. Instead, we will approach India's border and fight against that Hindu who shed the blood of Hyderabad and Kashmir's Mujahideen and Muslims. Our slogan is the similar slogan of our previous leaders; our slogan is the same slogan under which previous Pakistani Ulema have been martyred; that 'What is the meaning of Pakistan? There is no god except Allah.' We wish for Pakistan to flourish on its true foundation. To carry out this dialogue, we wish to eradicate Pakistan's current democratic, kufr system that has been set over us. I invite the respected Emir of Mehsud's Tribe's Mujahideen, Maulana Wali-ur-Rahman, to remove the doubts and suspicious of people on this current system. Maulana Wali-ur-Rahman (may Allah Protect him) All Praise is for Allah and may peace and blessings be upon the Messenger of Allah. To proceed... I seek refuge in Allah from Shaytaan, the outcast. In the Name of Allah, Most Compassionate, Most Merciful “And if you obey most of those in the earth, they will lead you astray from Allah's way.” [Al-'Anaam: 116] And the Messenger of Allah (peace and blessings be upon him) said, “Each one of your is shepherd. And each one of you will be asked about your flock.” Respected Emir of Tehreek-e-Taliban Pakistan, Hakimullah Mehsud, explained in detail the reasons of our war against Pakistani establishments, Pakistani army, Pakistani rulers. He answered the questions: What are our reasons of fighting them? What are our objectives? Now, the question remains about the current system of government, which is democratic. There can be greater explanations of this issue. But shortly, here I put forth a few points without explanations to you; that for any system to be Islamic, there are two conditions: First: The ruler must be a Muslim, which is an indispensable element. Second: A system of Shari'ah should be implemented. Hence, for any system to be Islamic, these two conditions are to be followed: that the Khalifah should be a Muslim and Shari'ah should be implemented. Now, you can tell me if the present rulers are Muslims or not. It is obvious that Musharraf, Zardari, and Kayani sold numerous innocent Arab Muslims and Pakistani men, women, and children to America. After they have adapted kufr laws, how can they be Muslims? They are most loyal in their friendship with the kuffar, and are the perpetrators for the murders of thousands of Muslims. Therefore, we cannot call them Muslims. The second part is the system's requirement to be Islamic. There are no dissensions on this topic. All religious parties and even our brothers who are part of this democratic system have a concord that the current democratic system is not Islamic. If it is not Islamic, then obviously it is a kufr regime. Even though many people hesitate to call this a 'kufr' system, it is apparent that if it is not an Islamic system, and this is agreed by everyone, then it becomes manifest that this system is given by the English. Today in Pakistan, there is no Shari'ah's establishment rather there is a system dispensed by English. This governmental system is democratic, which is Shirk in its entirety. Secondly, family and man-made laws are enforced in this land which, by any means, cannot be considered Islamic. The third part is usury (Riba/interest) which is equivalent to war against Allah and His Messenger. Allah has declared this as a war against Him and His Messenger. So this is Pakistan's subsistence: a livelihood that is based upon usury and on its already-kufr system. Therefore, we cannot regard it as Islamic by any means. Here, I would specially like to mention a bill that was passed under the name of Family Rights few ages ago. Ulema were in united agreement that this bill was un-Islamic, kufr, and self-made. In this course, I would like to state that Islam is a system; a complete way of life, and democracy in contrast to it is a man-made system. So we have two laws: first is Allah's law, which we interpret as Shari'ah; and second law is constructed by human mind and thoughts known as democracy, where laws are made and erased by humans themselves. Whereas the ordinance given by Allah is Shari'ah, which cannot be changed or altered in any way. Regarding democracy, I recited a verse in front of you. Allah says: “And if you obey most of those in the earth, they will lead you astray from Allah's way. They follow but conjecture and they only lie.” [Al-'Anaam: 116] So here, Allah has explicitly negated democracy. It is not possible that we follow the trail of the majority. This cannot happen. In this series, numerous Ulema of the subcontinent have given fatwas which includes Maulana Ashraf Ali Thanvi, Maulana Yusuf Ludhianwi (may Allah have Mercy on him), Maulana Ataullah Shah Bukhari, Abdul Rahman Kilani, etc. And numerous prestigious scholars have given fatwa that democracy is against Islam. So there is no doubt that democracy is a separate system that collides with Islam. It is a strange 'Islamic democracy' where America appeals the Mujahideen to join, sometimes in Afghanistan, sometimes in Pakistan, and Somalia, and sometimes in Palestine, and Iraq. Our invitation is a call towards no one except Allah, and we wish to enforce a Shari'ah system here so that the Hukm of Allah Alone is authorized in Pakistan. It shouldn't happen that one man gets up, and then there's an assembly that creates a law. A second assembly arrives and then abrogates the same law. Like in Europe and London etc., until that the homosexual laws are passed saying that a man can fulfill his desires from another man. So in this democratic system, there is a complete freedom and shamefulness, and it has always been clashing with Islam and unity can never be brought. Allah says: “And fight them until there is no more Fitnah and the religion will all be for Allah Alone.” [Al-Anfal: 39] So we will interpret 'Fitnah' as the creation of a system through human mind, which can never amalgamate with Shari'ah and Allah's Deen. In this course, many brothers will also state that we should lay down our weapons and join them in their journey of democracy, whereas we consider it as kufr. Joining their hands in kufr and then confronting it is something that can never happen. Instead, remaining outside kufr and then confronting it can only lead to its abolishment. We cannot become a part of this kufr and then try to confront it because as I said before: Allah stated: “And fight them until there is no more Fitnah.” [Al-Anfal: 39] and Prophet Muhammad said: “I have been ordered to fight people until they say Laa Ilaha Illa Allah.” So the kuffar, Jews and Christians are our enemies. Accepting their system, living in it, and then confronting it can never happen. The only singular pathway which remains requires that we arise, perceive the religious concern of honor bound to defend, and sense Islamic fervor and fight them until this Fitnah ends. Now I come to the matter, what do we want to bring in as a replacement by crushing democracy? Allah says in another occasion: “(They are) those who, if We give them power in the land, (they) enjoin Salat, pay the Zakat and enjoin good, and forbid evil.” [Al-Hajj: 41] This Islamic authority has been described by these foundational objectives of Shari’ah that if Khilafah is given to someone then what will be his responsibilities? Amongst them, the top-most are the establishment of Salat and Zakat and every obligatory ruling and law of Islam is to be implemented. These are the basic objectives of Shari’ah. He [who is given Khilafah] enjoins Al-Ma'ruf and forbids Al-Munkar, preserves the Islamic teachings, and performs Jihad against the kuffar, collects Jizya, and implements Shari'i rulings upon Muslims - which comes under forbidding Al-Munkar. In summary, it is obligatory on ourselves to abide by Shari’ah and also adhere others to it by enjoining good and forbidding evil. According to Shari’ah, it is also necessary to reform, revive, and train the Muslims. In an Islamic government, there is salvation from things such as the police of English system, complicated court systems, law-courts, and offices - what is interpreted as 'Law and Order' in today's times. In Shari’ah, there are Ulema and Qazis, and it is not something extraordinary that in today’s times Emir-ul-Mumineen Muhammad Omar Mujahid (may Allah Protect him) has accomplished this in his rule which is an example for the whole world. In our country, when the Swat Mujahideen established a similar system, it couldn't be digested by these flagitious people and they plotted against them, defamed them on the media, and began an army operation against them. Had it not been the Will of Allah, we wouldn't have believed that we could ever have an example like this. They have given a lot of sacrifices as did every tribe and Pakistani nation. Ours is an objective that cannot be forsaken, therefore we say and appeal to every brother who lives in Pakistan or a brother in any corner of the world not to look at the region's high-minded and faithful Muslims as the way the world and the media looks at us: that we are 'terrorists,' this-and-that. Instead these people are enlightened by the teachings of Prophet Muhammad (peace and blessings be upon him), who sacrificed their body, fortunes, and soul for the sake of Allah's Deen. Insha'Allah history will illustrate that these people are not terrorists, but Islamic heroes. History will note that these people are Islam's devotees and Islam's martyrs. In history, they will be written as heroes, not terrorists. And their opponents - Pakistani army, institutions - who call themselves 'Muslims' - will be noted as traitors and agents of others in history. Insha'Allah history will affirm this. And on every cost, we will defend our integrity and dignity, and maintain Islamic honor bound. For the implementation of Islamic Shari'ah in Pakistan, we will maintain our struggle on every brink until our breath escapes Insha'Allah. Until the last drop of blood escapes, we will continue this struggle. Our manifesto will be to bring an Islamic system in Pakistan and grant relief to the people of this democracy, from which they are utterly sick of, Insha'Allah. And this is not beyond the capability of Allah. Saudi jets "dropped US made white phosphorus bombs".
The Saudi air force has attacked rebels in northern Yemen following Wednesday's killing of a Saudi security officer in a border area, reports have said. Saudi aircraft had targeted strongholds of the Houthi rebels on the Yemeni side of border, spokesmen for the group and Arab media said. A Saudi official told Reuters they had hit rebels occupying its territory. The attacks came after a Saudi officer was killed and 11 were wounded in a raid by the rebels on the Jizan region. The Houthis said on Wednesday that they had taken "full control" of a mountainous section of the border region of Jabal al-Dukhan. 'Successive air strikes' In a statement on its website on Wednesday, the group said Saudi warplanes and helicopters had dropped phosphorus bombs on its fighters in the areas of al-Malahaid, Jabal al-Mamdud, al-Husama and al-Mujdaa. On Thursday, rebel spokesman Mohammed Abdul Salam said the bombs had hit "crowded areas including local market in the northern province of Saada". "They claim they are targeting Houthis, but regrettably they are killing civilians like the government does," he told the Associated Press. "The attacks were followed by hundreds of shells from the border."

CCriminal convictions of 22 CIA agents in Italy. Part I
The accountability imposed by another country for the CIA's kidnapping and torture reveals much about our own. Glenn Greenwald November 5, 2009 (updated below - Update II) The criminal conviction of 22 CIA agents (and 2 Italian intelligence officers) by an Italian court yesterday -- for the 2003 kidnapping of an Islamic cleric, Hassan Mustafa Osama Nasr, off the street in Italy and his "rendition" to Egypt to be tortured -- highlights several vital points: First, illustrating how these matters are typically distorted by the U.S. establishment media, note that CNN -- in the very first paragraph of its story -- claims that the CIA agents were convicted "for their role in the seizing of a suspected terrorist in Italy in 2003." What did Nasr allegedly do that warrants that "terrorist" label? Did he participate in the 9/11 attacks, or plan attacks on "the American homeland" or U.S. civilians? No. According to CNN, this is what makes him a "suspected terrorist": He was suspected of recruiting men to fight in Iraq and Afghanistan. So the West invades, bombs and occupies Muslim countries, and when Muslims attempt to find people to fight against the West's invading armies, those individuals are deemed "terrorists." Or consider this quite informative 2005 Washington Post article, which details how the CIA's kidnapping derailed the Italians' criminal (i.e., legal) investigation of Nasr; that article explains: Nasr was wanted by the Egyptian authorities for his involvement in Jemaah Islamiah, a network of Islamic extremists that had sought the overthrow of the government. The network was dispersed during a government crackdown in the early 1990s, and many leaders escaped abroad to avoid arrest. Continue Reading The Egyptian government, long propped up by the U.S., is one of the most tyrannical and brutal in the world. But Egyptians who work to overthrow that government are deemed "terrorists" by the U.S., and we're apparently willing to kidnap them from around the world -- including from countries where they've received asylum -- and ship them back to our Egyptian friends to be imprisoned and tortured. For many Americans -- probably most -- the word "terrorist" conjures up images of the people responsible for the 9/11 attack. For that reason, labeling someone a "suspected terrorist" can justify doing anything and everything to those individuals (after all, other than civil liberties extremists, who could object to the "seizing of a suspected terrorist" -- or their indefinite detention or torture?). It's therefore unsurprising that the U.S. Government would use the term "terrorist" so promiscuously and selectively (see John Cole's excellent contrast between what we deem to be "terrorism" when it happens to the U.S. versus what we deny is "terrorism" when done by the U.S.). It's a powerful term that can justify almost any government action. But the U.S. media's willingness to mindlessly apply the term "terrorist" in exactly the subjective, self-serving way the U.S. Government dictates -- starkly contrasted with their refusal to use the far more objective term "torture" on the ground that the term is in dispute (i.e., disputed by the U.S. Government torturers) -- illustrates the establishment media's principal function: to serve American political power and justify whatever our government does. That's a major reason -- perhaps the primary one -- why the U.S. Government has been able to get away with everything it's done over the last decade. Those unseen victims of torture, rendition, indefinite detention and other government crimes are all just "terrorists," so who cares? In reporting on these convictions, CNN immediately and helpfully proclaims Nasr to be a "suspected terrorist" in a way that guts any meaningful definition of that term and -- in many minds -- justifies whatever was done to him, no matter how illegal. It's worth asking this question: which sounds more like actual "terrorism": (a) kidnapping people literally off the street and shipping them thousands of miles away to be tortured with no legal process, or (b) what Nasr is "suspected" of having done? Second, this incident underscores -- yet again -- that our political and media elite simply do not believe in the rule of law or accountability for high government officials. To the contrary, they explicitly believe that such officials should be entitled to break the law and be exempt from consequences. TOOBIN: This is a real criminal conviction in a country where we tend to honor reciprocal legal arrangements. So they are in a -- they are in no jeopardy as long as they are inside the United States, but, if they were to leave, they are potentially at risk for being jailed and brought to Italy. BLITZER: Because even if they went to a third country, like England, let's say, or France, Interpol could have a warrant out for their arrest. They have been convicted by an Italian court. TOOBIN: That's why this is such -- *so troubling.* It would one thing if they only had to stay out of Italy, but, because of Interpol, because of the reciprocal nature of these agreements, they are potentially at risk almost anywhere they go. So according to Toobin, this is all "so troubling." Why? Because the people who were found by a duly constituted court to have committed a serious crime are faced with the risk that there might actually be consequences. After all, these are Americans who were part of the U.S. Government, and consequences for lawbreaking are simply not meant for them. Echoing Joe Klein's infamous Orwellian claim that torture shouldn't be prosecuted because the CIA is "asked to behave extra-legallyalso a violation of U.S. law (after Nasr's kidnapping, the chief of the CIA's Milan office traveled to Egypt for three weeks to participate in his "interrogation"). for the greater good of the nation," Toobin added that "one of the things you do when you are a CIA agent, at least in part, is break the law of other countries" -- Toobin says that as though they have the right to do that without accountability, and without mentioning that causing people to be tortured is Third, the glaring contrast between (a) the United States and (b) countries that (at least partially) adhere to the rule of law and precepts of accountability continues to grow. As we saw earlier this week, a U.S. appellate court ruled that American government officials are immune from consequences even when they abduct an innocent man and knowingly cause him to be tortured -- even after the Canadian government publicly disclosed its detailed investigation of that matter, publicly apologized to the victim, and paid him $9 million. Spain continues to pursue the possibility of criminal prosecution of our high government officials for war crimes even as our own government insists that our war criminals (at least all those but the lowest-level ones) should be immunized and we should look forward, not backwards. Our attempt to compile a "hit list" of Afghan citizens we intend to murder because we suspect them of drug trafficking prompted angry objections from Afghan officials that our plan violated due process and the rule of law. And now an Italian court demonstrates actual judicial independence and adherence to equality under the law by holding American and Italian government kidnappers liable for their complicity in torture -- something our own government institutions have repeatedly failed and/or refused to do (Harper's Scott Horton has much more on the glaring contrast between U.S. and Italian political values that is reflected here). Finally, this isn't about the past -- at least not exclusively. The U.S. Government continues to refuse even to comment on what it did here. The State Department yesterday expressed "disappointment" with the Italian court ruling -- just as it did explicitly decided to continue the "rendition" policy which led to Nasr's illegal kidnapping, albeit with the addition of anti-torture "safeguards" similar in language if not effect when compared to those in place under Bush (it remains to be seen to which countries these "rendered" suspects will be sent, and whether the renditions will be the illegal kind practiced by Bush/Cheney or the arguably "legalized" form with Reagan through Clinton). And most notably of all, we continue to be a country which -- in the name of secrecy and national security -- insists that the rule of law and accountability simply do not apply to our highest government officials when they break the law. Fortunately, other countries -- slowly and incrementally -- are rejecting that pernicious view. when a British High Court recently ordered the disclosure of evidence of American torture. The DOJ continues to insist that no American courts can examine past rendition and torture cases on the grounds of secrecy. The Obama administration has that took place before that, beginning UPDATE: One of the convicted CIA agents admits to ABC News that they "broke the law" when kidnapping Nasr and claims, credibly, that everything they did was approved back in Washington. This is as good a time as any to post this new and important 9-minute video from the ACLU (with whom I consult), in which you hear from numerous individuals who were abducted and held for years at Guantanamo with no charges or trial of any kind -- only to be released with no explanation, apology or accountability. This is really worth watching; like the absence of civilian deaths caused by our wars, it's the key missing piece from typical media coverage that really illustrates what we've been doing: UPDATE II: Peter Bergen traveled to Italy to review all the court documents in this case and then to Egypt to interview Nasr. For the March/April 2008 issue of Mother Jones, he wrote an excellent and very detailed account of what was done to Nasr, who was responsible, and what lead the Italian prosecutors (who had been investigating Nasr) to pursue the case against the CIA agents (h/t Adam Serwer). It is well worth reading.

American hell... in Fort Hood!
Officials say suspect at Fort Hood has been identified as Maj. Malik Nadal Hasan, who they say was an Army mental health professional, The Associated Press reported. (CNN) -- At least one soldier opened fire on a military processing center at Fort Hood in Texas on Thursday, killing 12 and wounding 31 soldiers, officials at the Army base said. The gunman, who officials initially said was killed, is wounded but alive, Lt. Gen. Bob Cone said. Cone said that man is believed to be the only shooter. Two other soldiers briefly taken into custody after the incident were later released, a spokesman said. The gunman, who officials said was wounded by emergency personnel, was identified as Maj. Nidal Malik Hasan, 39, a law enforcement source told CNN. A graduate of Virginia Tech, Hasan was a psychiatrist who was licensed in Virginia and was practicing at Darnall Army Medical Center at Fort Hood, according to professional records. Previously, he worked at Walter Reed Army Medical Center. A federal official said Hasan is a U.S. citizen of Jordanian descent. Military documents show that Hasan was born in Virginia, and was never deployed outside the United States. Hasan was scheduled to be deployed to Iraq "and appeared to be upset about that," Sen. Kay Bailey Hutchison, R-Texas, said. "I think that there is a lot of investigation going on now into his background and what he was doing that was not known before," Hutchison said. At least 10 of the dead also were soldiers, Cone said. A witness in a building adjacent to where the shooting happened said soldiers were cutting up their uniforms into homemade bandages as the wounded were brought into the building. "It was total chaos," the witness said. A soldier who asked not to be identified told CNN that an e-mail went out to all base personnel instructing them not to speak to the media. President and liar Obama called the shootings "tragic" and "a horrific outburst of violence." He expressed his condolences for the shooting victims. Obama promised the bring all troops home from Iraq yet he is still sending them towards Iraq.

Gunmen again target army officer in Pakistan by Asif Shahzad
By Associated Press writer Asif Shahzad ISLAMABAD – Gunmen on a motorcycle wounded a senior army officer and soldier in the Pakistani capital Friday, the third such attack in about two weeks as militants retaliate against a new military offensive along the Afghan border. The militants hope the wave of attacks, which has killed some 300 civilians and security forces in the past month, will weaken the army's resolve as it pushes deeper into South Waziristan, the mountainous stronghold of the Taliban and al-Qaida in Pakistan. Gunmen opened fire on the army officer, who holds the rank of brigadier, shortly after he drove from his home in a residential district of Islamabad, said police official Khan Khurshid Khan. The gunmen sped away after the attack, he said. Hospital official Arshad Khokhar said the brigadier Sohail and the soldier, who was also in the vehicle, were in stable condition. A brigadier is equivalent to a brigadier general in the U.S. Army. The brigadier was wearing civilian clothes when he left his home in his official vehicle, said Khan. Such vehicles often bear army insignia on the license plates. It was unclear if the officer was involved in the South Waziristan offensive, which was launched in mid-October. The shooting followed two similar attacks against army officers last month in Islamabad.

The CIA relied on intelligence based on torture in prisons in Uzbekistan, a place where widespread torture practices include raping suspects with broken bottles and boiling them alive, says a former British ambassador to the central Asian country.

Craig Murray, the rector of the University of Dundee in Scotland and until 2004 the UK's ambassador to Uzbekistan, said the CIA not only relied on confessions gleaned through extreme torture, it sent terror war suspects to Uzbekistan as part of its extraordinary rendition program.

"I'm talking of people being raped with broken bottles," he said at a lecture late last month that was re-broadcast by the Real News Network. "I'm talking of people having their children tortured in front of them until they sign a confession. I'm talking of people being boiled alive. And the intelligence from these torture sessions was being received by the CIA, and was being passed on."

Human rights groups have long been raising the alarm about the legal system in Uzbekistan. In 2007, Human Rights Watch declared that torture is "endemic" to the country's justice system.

2 Israelis arrested for kidney trafficking

According to the suspicions, the two published newspaper ads offering to mediate in kidney donations. They would then connect between a person seeking to sell a kidney and a person seeking to buy one.

Each such surgery would cost about $200,000. The operation would be performed abroad, mostly in South America or China.

For each such mediation, Shem-Tov and Orenstein were said to have received tens of thousands of dollars. The people who "sold" their kidney received only a small part of this sum. The police are now checking how many such deals took place and how long the activity lasted.

A day after their arrest, the two suspects were brought to the Jerusalem Magistrate's Court, where their remand was extended. Orenstein was placed under house arrest on Wednesday.

According to the organ transplant law, organ trafficking and selling is forbidden. The law went into effect last year and since then the act is considered a criminal offense.

At this stage, the Hadassah Ein Kerem Hospital is not believed to be linked to the affair, although the two suspects were arrested on its premises.

KABUL, Nov. 5 (Xinhua) -- A crowd of Afghans came to the streets of Helmand's provincial capital Lashkargah in south Afghanistan Thursday and denounced what they described arbitrary killing of civilians.

"Around 100 people carrying some dead bodies in Lashkargah Thursday morning accused NATO-led forces of killing nine civilians and calling on the government to investigate and punish those responsible," a protestor and demonstrator Hajji Hafizullah Khan told Xinhua.

He added that a NATO plane dropped a bomb on a family who were busy harvesting corn in their land in Babaji area outside Lashkargah, killing nine persons, including three children.

Meantime, spokesman of provincial administration Daud Ahmadi in talks with Xinhua confirmed the incident but said that all those killed were Taliban insurgents.

Taliban purported spokesman Qari Yusuf Ahmadi in talks with media via telephone from undisclosed location claimed that all those killed in the bombardment were not Taliban fighters.

A similar incident, which claimed the life of a civilian in the eastern Khost province, also took hundreds of people to the street on Thursday.

PRÉVENIR L' ARBITRAIRE VACCINAL À L' ÉCOLE
La grippe porcine a causé bien moins de mort dans le monde depuis son apparition que la grippe dite «normale» chaque année. Et je ne parle pas du paludisme. Force est de constater qu'une psychose mondiale a été entretenue (par l'OMS et nos gouvernements avec la complicité des médias de masse). On peut dès lors se poser la question du pourquoi ? Une vaccination n'est pas une opération médicale anodine. Il faut parfois plusieurs années pour pouvoir étudier les effets secondaires. Je pense notamment aux polémiques, encore d'actualité, sur le vaccin contre l'hépatite B. Comment penser alors qu'un vaccin mis point en quelques semaines puisse offrir un minimum de garanties pour les humains ? Si l'on ajoute à cela que les laboratoires ont obtenu, pandémie oblige, une immunité contre les poursuites judiciaires à venir et que leurs vaccins contiennent des adjuvants toxiques comme le squalène (adjuvant huileux mis en cause dans le syndrome de la guerre du Golf) et le thiomersal (antibactérien au mercure!) , il y a de quoi vraiment s'inquiéter. Des milliards d'euro ont été dépensés par l'état français pour équiper notre pays de stock de Tamiflu et de vaccins. Il va bien falloir les utiliser. Or quand on sait que le corps médical, très exposé à la grippe porcine, refuse pour plus de la moitié ce vaccin et que l'opinion publique y est également plutôt défavorable... Notre gouvernement a beaucoup parlé de vaccination obligatoire, mais si cette éventualité semble à l'heure actuelle écartée, il reste une inquiétude majeure concernant la vaccination des enfants dans le cadre scolaire, et de nombreuses voix s'élèvent pour attirer l'attention des parents sur ce point. Si dans les semaines qui viennent des opérations de vaccination sont organisées dans les établissements scolaires, seuls les enfants dont les parents auront clairement pris position contre cette «vaccination de force» auront la possibilité de la refuser. Tous ces éléments me poussent aujourd'hui à vous transmettre cette information. Aujourd'hui le préfet du département du Lot vient de rendre publiques les mesures prévues pour la vaccination en masse. Plusieurs équipes mobiles seront déployées pour vacciner à tour de bras dans les écoles... Mieux vaut prendre la précaution d'envoyer une lettre en recommandé avec accusé de réception au directeur de l'établissement scolaire, précisant clairement que vous êtes contre tout vaccin éventuel contre la grippe H1N1 sur votre enfant. Assurez-vous que votre bambin en garde un exemplaire toujours sur lui et garder vous-même un autre exemplaire à la maison. Si vous êtes inquiets à l'idée que ce vaccin soit inoculé à vos enfants, prenez le temps de faire ce courrier. Si cet épisode de vaccination intervient rapidement, sans cette précaution urgente, il sera trop tard. VACCINATIONS: 3 bébés meurent aux Pays Bas.
Le vaccin contre la pneumocoque nommé Prevenar avec comme numéro de lot D66977 ne pourra plus être utilisé jusqu'à nouvel ordre. C'est l'instance gouvernementale au Pays Bas, la CIB RIVM qui l'a décidé ainsi. Le fabricant Wyeth a demandé de mettre de côté le numéro de lot en attendant les investigations en cours sur les trois décès enfantines récentes après la vaccination. Les enfants ont reçu la vaccination dans le cadre du programme national de vaccination, l'âge variait de 3 à 6 mois. Les bébés sont morts entre 1,5 jour à 11 jours après la vaccination. À l'heure actuelle, la cause du décès n'est pas encore connue. Chaque année, la RIVM 5 reçoit plus de 10 rapports d'enfants qui sont décédés après une vaccination. Parce que les trois enfants sont décédés dans un délai de 1,5 semaines, l'instance gouvernementale a enfin décidé de ne plus les utiliser jusqu'à nouvel ordre. Ceci est une mesure de précaution. Un peu tard, non ? D'autres recherches sont en cours pour déterminer la cause du décès. Deux des trois bébés décédés ont également reçu un vaccin « DTC-HepB-Hib ». Les numéros de lot sont également identiques. Le troisième enfant, a reçu le DTC-Hib. Toutes les boîtes et / ou seringues de Prevenar avec numéro de lot D66977 doivent être muni d'une étiquette «NE PAS UTILISER» et devrait être mis de côté dans le réfrigérateur. Tous les décès ont été vaccinés dans le cadre du programme national de vaccination et ils sont morts endéans les dix jours après la piqûre. The UN Secretary General said that he would join efforts with other members of the Security Council to find those behind this incident and give them punishment. On the other hand, we have hundreds of examples in which we find the United Nations behaving with the Islamic Ummah unfairly, improperly and pitilessly as far as global and regional issues are concerned. When it comes to the protection of the rights of the Ummah, this World Body, particularly, the Security Council becomes silent at once. They have chosen the way of suppressing and oppressing the Ummah and supporting the arrogant, the invaders and the brutals. If we have a glimpse at events in Palestine, Iraq and other issues and the bloodbath now going on at the level of the Ummah, we will readily know that how callously and brutally the invading colonialists kill common Muslims collectively and invade Islamic lands flagrantly. If we look at the horrendous events in our country , Afghanistan during the past eight years, we will see clearly that the Security Council with its full strength is siding with America and the coalition forces. They have their share in the mass murders of the Afghan people and are the cause of the tragedies and sufferings of the Afghans. During the past eight years, never a day has passed without the Americans and Western brutal forces not committing crimes, murder, or torture against our people or not encroaching on our national and religious values. The blind bombardment on civilian targets, night raids on people houses, murders, tortures, bombardments on funeral and wedding ceremonies are some of the crimes, the invaders have perpetrated during the past eight years. But the United Nations has turned a blind eye to these crimes and not acted as per its responsibilities and caliber as a universal body. Throughout this period, they only ratified and approved resolutions allowing prolongation of occupation of Afghanistan and reinforcement there. Ironically, they have called for more brutality under the leadership of USA. We have not seen any resolution by the Security Council, which speaks of grace, tolerance and altruism. Contrarily, when American and Western targets are attacked, or their interests are targeted or Western nationals are assassinated and similarly, when the interests of the Christian world come under danger, then the Security Council holds emergency meetings and issues serious response and reaction. The strong reaction shown by the Security Council following the murder of a few Western staff members, portray that this organization has taken upon itself as its only duty to exclusively protect Western nationals and their interests. If hundreds of people other than the Western nationals are killed in the world in a single day, they do not take any notice because in their eyes they are less than human beings and the United Nations does not feel to be morally bound to protect their rights. Two Enemy Soldiers Dead, 5 Wounded

Two US enemy soldiers were killed and five others were wounded in a rocket attack targeting their base located near Baghdad International Airport, western Baghdad. A confidential source said that the army of occupation in turn acknowledged the incident, but as usual, gave a different number of injuries saying that seven soldiers were wounded in missile attack targeting the base."

On the other hand eyewitnesses confirmed that "five mortars were all directly felt down at central base for American occupation forces. Sound of explosions were heard just following the attack from far distances where there were dense clouds of smoke."

According to witnesses "U.S. occupation forces had immediately launched sirens and random gunfire tightening security measures on the base."

Has Baxter International released a biological weapon?
David Rothscum reports: Evidence appears to suggest that Baxter International is responsible for a new deadly outbreak of viral pneumonia in Ukraine. In February of 2009 Bloomberg reported that Baxter "accidentally" send vaccine material containing both live Avian bird flu and seasonal influenza to multiple laboratories worldwide. A laboratory decided to test the vaccine on it's ferrets, but the ferrets all unexpectedly died. It must be noted that Baxter has made a "mistake" like this before. Blood products produced by Baxter once containd HIV. Thousands of haemophiliacs died due to this, and many went on to infect their spouses. Later in the year, a bizarre story emerged on the internet. The Huffington Post reported on a a man named Joseph Moshe who was arrested after a hours long standoff with the police because he had supposedly made threats against the White House. The man was able to withstand multiple rounds of tear gas. However, the internet community was very skeptical of the true reasons behind this man's arrest. Comments on the Huffington Post website immediately began pouring in about an unreported side to this story, namely that Joseph Moshe was a Mossad Agent specialized in biological warfare who called into a radio show to warn people about a biological weapn that was being made by Baxter international that would be spread through vaccine and would cause a plague upon it's release. Although anyone can make a doomsday claim and we should never believe anyone (and it must be said that the Truth movement handled this well, the message was spread without being proclaimed as gospel) the amazing part about Moshe's claim was the location where Moshe said the biological weapon was being produced. Moshe claimed that Baxter's laboratory in the Ukraine out of all places was creating this biological weapon. All of this came out in the beginning of August, which is more than 2 months before the situation that is currently unfolding. For Moshe to correctly name the country where a new epidemic would be unleashed, requires either inside information, or an incredible coincidence as anyone with a basic knowledge of statistics can confirm for himself. Let us assume for a moment that every person on our planet has an equal chance of giving rise to a new lethal epidemic due to a virus that mutates as it spreads through his body. The Ukraine has 46 million inhabitants. The current estimated global population is about 6.7 billion. This means that if a new epidemic were to arise, the chance of this epidemic starting in the Ukraine would be 0.69%. However, it appears that this virus is a form of flu. This makes the odds of being right when guessing that a deadly flu is going to break out in the Ukraine even smaller. The reason for this is that back in early August the vast majority of influenza infections were found in different countries than the Ukraine. In fact, on 30 Oktober, Earthtimes reported that Ukraine had officially reported only two cases of swine flu, and no deaths, until last Friday. This deadly epidemic appears to have arrived out of nowhere in the Ukraine. Moshe's biomed profile appears to confirm his position as a microbiologist. this page with Baxter's contact information for it's Ukraine office confirms that Baxter has a presence in the Ukraine. It must also be noted that massive numbers of microbiologists have been dying bizarre deaths. This case of what appears to be a brave man who sacrificed it all to bring us this message may explain why so many microbiologists have been murdered. The fact that this man managed to predict an outbreak of highly lethal influenza in a place where we would least expect it, 2 months before it a actually occured, lends credence to his claim that Baxter International is responsible for the outbreak and shows that top microbiologists can pose a problem to the people responsible for this ongoing disaster. This is a developing story, expect to see possible updates on David Rothscum Reports as more information on what is happening in Ukraine becomes available. Update 1: For the purpose of keeping information from disappearing, I am going to mirror most information I can find on here. Comments on the Huffington post website on an article about Moshe's arrest documenting his claim that the Influenza virus in a vaccine manufactured by Baxter in Ukraine replicates RNA from the 1918 flu and is meant as a bioweapon: Furthermore, Update 2: The Ukrainian government wants to impose travel restrictions on people across the nation to stop the virus from spreading. Update 3: According to the Huffington post comments I cited above, Dr. Moshe claimed that the virus used replicated RNA of the 1918 Spanish flu. Symptoms of the 1919 Flu include victims being drenched in blood: American were familiar with the flu; it sent you to bed, made you miserable for 3 or 4 days with fever, muscle aches, and congestion, then left you shaky for about a week. It made millions sick, yet killed only the oldest, youngest, and most feeble. The 1918 influenza was not the flu Americans were familiar with. It was a horror that turned victims bluish-black then drowned them with their own body fluids. the death toll was highest in the ages 15 to 40, those in the peak of health. The victims would be fine one minute and the next incapacitated, fever-racked, and delirious. Temperatures rose to 104-106 degrees, skin turned blue, purple, or deep brown from lack of oxygen. Massive pneumonia attacked the lungs, filling them with fluid; blood gushed from the nose. Death was quick, savage, and terrifying. Compare this to reports that are coming out from Ukraine: Five persons have died from the flue in Lviv, four men and one woman, says emergency hospital chief doctor Myron Borysevych. Two of the dead patients were in the 22-35 age group, with 2 others over 60. He diagnosed the disease as viral pneumonia. (...) Viral tests can last from one to two weeks. They are complicated and not done in Lviv. The course of the disease was very quick. The symptoms included very high temperature and short-wind cough. (...) All the six dead young people had symptoms of severe hemmorhagic pneumonia. The disease starts slowly, with temperature rising to 37.2 – 37.3 degrees, slight cough and pain in joints. Nasal catarrh developed at the end of the second or third day. Autopsy revealed that the lungs were soaked with blood, the oblast chief specialist said.

Israeli man arrested for alleged rape of 10 children
By Haaretz Service CLOSE [X] A Petah Tikvah man, 23, was arrested Tuesday on suspicion of attacking, molesting, and raping at least ten children aged 8 to 11 during recent months. The man allegedly met the children on the street and threatened them with violence if they didn't succumb to his demands. Children recounted that the suspect used different means by which to gain their trust and entice them to side streets where he then molested them.
